22349 vc Description -  22349 vc is the California Vehicle Code Section that sets the maximum speed limit for all California roadways, which is 55 mph (22349 b vc) on two lane undivided roadways and 65 mph (22349 a vc) on all other roadways such as interstate highways or state highways. The empirical data in both of these studies shows that setting the speed limit too high or too low can result in an increase in the number of collisions.  Speed limits that are set at or near the 85th percentile (critical) speed of free flowing traffic are safer for the drivers and produce less variance in vehicle speeds.  Therefore, the 85th percentile is used to set the upper limit of the speed limit and it is considered reasonable and prudent.

Furthermore, if speed limits were set arbitrarily at lower speeds then a disproportionate number of drivers would be violators. This does not facilitate the orderly movement of traffic, and requires constant enforcement to maintain compliance.
