How long does an officer have to respond to a trial by written declaration?

How long does an officer have to respond to a trial by written declaration? How long does an officer have to respond to a trial by written declaration - Instructions to arresting officer: If the traffic court clerk receives a Request for Trial by Written Declaration (form TR-205) and bail by the due date from the defendant, the traffic court clerk must send the arresting officer's agency "Notice and Instructions to Arresting Officer" (form TR-210) and Officer's Declaration (form TR-235) with a copy of the Notice to Appear. The court clerk must specify a return date for receiving the officer's declaration. After receipt of the officer's declaration, or at the close of the officer's return date if no officer's declaration is filed, the clerk must submit the case file with all declarations and other evidence received to the court for decision.

Normally, the time given to the arresting officer to respond to a trial by written declaration is 30 days. If the officer fails to submit the officer's declaration to the court, the chances are that the traffic ticket will be dismissed, however there is no guarantee of dismissal. The court may still issue a verdict other than a dismissal depending on the information that was submitted by the defendant. There are situations that the defendant may submit documents to the court which may be self incriminating and thus result in a non-dismissal. Therefore, it is absolutely critical for the person preparing a trial by written declaration to be aware of statements that may be self incriminating and avoid such statements. That is why many people will choose to have their statements drafted by professionals.
