Fight 22350 vc Speeding Ticket - Applying a 5 mph Speed Reduction

Fight 22350 vc Speeding TicketFight 22350 vc Speeding Ticket - According to the California MUTCD, A speed limit shall be established at the nearest 5 mph increment to the 85th percentile speed of free-flowing traffic. Under some circumstances, the posted speed may be lowered by 5 mph from the nearest 5 mph increment of the 85th percentile speed.

If a 5 mph reduction is justified, the speed zone study shall document the conditions used for the justification of the lower speed limit. The lowering of the speed limit must be approved by a registered Civil or Traffic Engineer. The reasons for the lower speed limit must be in compliance with California Vehicle Code Section 22358 vc.

The following two examples explain the application of the speed limit criteria:

  1. If the 85th percentile speed in a speed zone study for a location was 47 mph, then the speed limit would be established at 45 mph since the closest 5 mph increment to the 47 mph speed is 45 mph. The 45 mph speed limit may be reduced by 5 mph to 40 mph if the conditions and justification for using this lower speed limit are documented in the speed zone study and approved by a registered Civil or Traffic Engineer.
  2. If the 85th percentile speed in a speed zone study for a location was 43 mph, then the speed limit would be 45 mph since it is the closest 5 mph increment to the 43 mph speed. The 45 mph speed limit may be lowered by an additional 5 mph to 40 mph if the conditions and justification for using this lower speed limit exist and are documented in the speed zone study and approved by a registered Civil or Traffic Engineer.

California Vehicle Code Section 21400 vc provides for setting the speed limit at the 5 mph increment below the 85th percentile speed even if the rounding would require the speed to be posted above the 85th percentile speed. If this is exercised, then the additional 5 mph reduction cannot be used. In effect, this law allows an engineer to round down to the nearest increment of the 85th percentile speed instead of round up.

Many people fight 22350 vc speeding tickets based on the lowering of the speed limit without following the requirements. In California to use electronic speed detection devices such as radar or lidar for speed enforcement, a valid speed zone survey is required. In most cases the violation code 22350 vc is used for roadways where the speed limit has been lowered below the maximum speed limit. If the speed zone survey is not valid or it does not follow the requirements of the California Vehicle Code, then a speeding ticket for 22350 vc can be contested.
